Public Contract for Charity activities

Autonomous non-profit organization EAFO Educational and Research Center "Eurasian Oncology Program" (ANO "EAFO"), acting on the basis of the Charter, hereinafter referred to as the "Beneficiary", hereby invites individuals and legal entities or their representatives, hereinafter referred to as the "Benefactor", collectively referred to as the "Parties", to conclude a voluntary donation Agreement on the following terms:

1. GENERAL PROVISIONS

1.1. This offer is a public offer in accordance with paragraph 2 of article 437 of the Civil Code of the Russian Federation

1.2. Acceptance of this Offer is the implementation by the Benefactor of the transfer of funds to the account of the Beneficiary as a voluntary donation to fulfill the statutory goals and objectives of the Beneficiary in order to assist cancer patients, their relatives and friends, as well as to provide services in the field of health, education and science aimed at improving the level of knowledge in the field of Oncology and other related and auxiliary industries, including basic research, surgery, drug therapy, radiation therapy, medical diagnostics, physics, chemists, biologists, etc.

Acceptance of this offer by the Benefactor means that the latter has read and agrees to all the terms of this voluntary donation Agreement with the Beneficiary.

1.3. The offer comes into force on the day following the day of its publication on the official website of the Beneficiary – www.eafo.info, hereinafter referred to as the "Site".

1.4. The Text of this Offer may be changed by the Beneficiary without prior notice and is valid from the day following the day of its posting on the Site.

1.5. The offer is open-ended and is valid until the day following the day when the notice of cancellation of the Offer is posted on the Site. The Beneficiary has the right to cancel the Offer at any time without explanation.

1.6. The invalidity of one or more terms of the Offer does not entail the invalidity of all other terms of the Offer.

2. SUBJECT OF THE AGREEMENT

2.1. Under this Offer, the Benefactor transfers its own funds as a voluntary donation to the Beneficiary's Bank account, and the Beneficiary accepts the donation and uses it to implement the statutory goals and objectives of the Beneficiary in order to provide assistance to cancer patients and their relatives and friends. As well as providing services in the field of health, education and science aimed at improving the level of knowledge in the field of Oncology and other related and auxiliary industries, including basic research, surgery, drug therapy, radiation therapy, medical diagnostics, physics, chemistry, biology, etc.

2.2. Performance by the Benefactor of actions under this Offer is a donation in accordance with article 582 of the Civil code of the Russian Federation.

3. ACTIVITY OF THE BENEFICIARY

3.1. The purpose of the Beneficiary's activity is to provide assistance to cancer patients and their relatives and friends. As well as providing services in the field of health, education and science aimed at improving the level of knowledge in the field of Oncology and other related and auxiliary industries, including basic research, surgery, drug therapy, radiation therapy, medical diagnostics, physics, chemistry, biology, etc.

3.2. The Beneficiary hereby confirms that it is a non-profit organization. The Beneficiary does not have the right to use the funds received from the Benefactor for any other purpose.

3.3. The Beneficiary publishes information about their work, goals and objectives, activities and results on the website www.eafo.info, and in other open sources.

4. CONCLUSION OF THE AGREEMENT

4.1. To accept the Offer and thereby to enter into a Beneficiary Agreement can natural or legal person.

4.2. Unconditional Acceptance of this Offer is considered a donation by the Benefactor, and, accordingly, the date of conclusion of the Contract is the date the funds are credited to the account of Beneficiary. The place of conclusion of the Agreement is considered to be the city of Moscow in the Russian Federation.

4.3. The terms of the Agreement are determined by the Offer in the wording (subject to changes and additions) that is valid (effective) on the day of the payment order or the day of money transfer via the online payment system on the official website of the Beneficiary: www.eafo.info.

5. MAKING A DONATION

5.1. The Benefactor independently determines the amount of the voluntary donation and transfers it to the Beneficiary using any payment method specified on the website www.eafo.info.

When paying for an order with a Bank card, payment processing (including entering the card number) takes place on a secure page of the processing system that has passed international certification. This means that confidential data of the Benefactor (card details, registration data, etc.) is not received by the online store, their processing is fully protected, and no one, including the online store, can get the client's personal and Bank data. When working with card data, the information security standard developed by the international payment systems Visa and MasterCard – Payment Card Industry Data Security Standard (PCI DSS) is applied, which ensures secure processing of the Holder's Bank card details. The applied data transfer technology guarantees security for transactions with Bank cards by using Secure Sockets Layer (SSL), Verified by Visa, Secure Code and closed banking networks with the highest degree of protection.

6. RIGHTS AND OBLIGATIONS OF THE PARTIES

6.1. The Beneficiary undertakes to use the funds received from the Benefactor under this Agreement strictly in accordance with the current legislation of the Russian Federation and within the framework of its statutory activities

6.2. The Benefactor grants permission to process and store personal data used by the Benefactor solely for the performance of the specified Agreement.

6.3. The beneficiary undertakes not to disclose to third parties personal information and contact details of the Benefactor without his written consent, except for cases specified in clause 6.2 and the requirements of this information by state bodies authorized to request such information.

6.4. Donation received from the Benefactor, which is due to the closure requirements partially or not at all consumed for the Benefactor needs in the payment, not refundable to the Donor, and is redistributed by the Beneficiaries themselves on other statutory objectives including anti-cancer projects listed on the site: www.eafo.info.

6.5. Donations received from the Beneficiary, without naming the purpose of spending funds, without specifying in the purpose of payment "Charitable contribution", "Charitable donation", are recognized as charitable donations for the statutory purposes of the organization.

6.6. At the request of the Benefactor (in the form of an electronic or regular letter), the Benefactor is obliged to provide the Benefactor with information about the donations made by the Benefactor.

6.7. The Beneficiary shall not be liable to the Benefactor for any other obligations other than those specified in this Agreement.

6.8. In order to fulfill the Agreement, the Beneficiary may process the following personal data of the Benefactor: surname, first name, patronymic; date and place of birth; data of the passport or other identity document of the Benefactor (series, number, date of issue and the authority that issued the passport or other identity document, other information contained in the passport or other identity document); telephone number; taxpayer identification number; e-mail address; Bank account details; Bank payment card data used for making donations in favor of the Beneficiary; other personal data, the processing of which is necessary for the execution of this Agreement.

In accordance with paragraph 5 of part 1 of article 6 of the Federal law of 27.06.2006 No. 152-FZ "On personal data", the processing of the Benefactor's personal data For the purpose of performing the contract does not require a separate consent of the Benefactor.

The Beneficiary has the right to post on the site www.eafo.info on the pages of the Benefactor in social networks, mass media, and other printed or informational materials, information about the Benefactor-legal entity received in connection with the execution of this Agreement – the name, location, and amount of the donation.

7. OTHER TERMS AND CONDITIONS

7.1. In the event of disputes and disagreements between the Parties under this Agreement, they will be resolved through negotiations as far as possible. If it is impossible to resolve the dispute through negotiations, disputes and disagreements can be resolved in accordance with the current legislation of the Russian Federation in the courts of Moscow
